 You know what's even more annoying than smug, complacent, swaggering atheists?  Smug, complacent, swaggering agnostics.  Talk about missing the point. Don't click the link, it's dreadful. You'd think agnosticism would come with a sort of built-in humility as a standard feature, but I suppose it doesn't. The Templeton foundation needs to be razed. I can understand evangelical Christians. I can even understand evangelical atheists. But evangelical agnostics are just loudmouthed jerks. "I'm not certain" is a good answer to almost any question. "I'm not certain, and you aren't convincing" is okay. "I don't know, and you don't either" is trolling. _

For those who are interesting in such things, this post from Walter Dellinger makes two clever arguments against Doe vs. Reed. (the anonymous petition for referendum case)  In general, the whole Supreme Court breakfast table is excellent this year.  I'm particularly taken with the term "unconstitutionally vague" from the Skilling case.  I think it's the contrast between the two words.  It helps if you imagine it being said with a bit of a stammer in between the two words, and hand gestures.  I think it's a good doctrine, too!  Though it does rely on the legislature being functional, to correct the problem.  The one argument I find occasionally convincing for the full-fledged liberal vision of the courts assumes that Congress is inherently incapable of legislating, at which point, philosopher kings may be the best option. _
